All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

 

By purchasing an ‘INTERMAXX item’ you agree with our terms of service outlined here and these terms and conditions are to be taken into consideration and adhered to at all time whilst using your item. All users are advised that the use of any off our products is strictly conditional upon your confirmation that you comply fully with our terms of use. By proceeding to purchase a any item unit or use of this site, you signify your unequivocal acceptance of these and any other terms prevailing at this or at any future time. We cannot be responsible for amendments or alterations to our provided software or hardware

The governing law imposed will be that of the United States, the country in which we are based and from which all services are provided.

The relationship between you (the user) and us is that any unit or product provided is for your personal use only. It is provided to you on a purely non commercial basis and is, therefore, not that of customer and supplier.

Intermaxx does not host, provide, archive, store, or distribute media of any kind, and acts merely as an index (or directory) of media posted by other webmasters on the internet, which is completely outside of our control. Whereas we do not filter such references, we cannot and do not attempt to control, censor, or block any indexed material that may be considered offensive, abusive, libellous, obnoxious, inaccurate, deceptive, unlawful or otherwise distressing neither do we accept responsibility for this content or the consequences of such content being made available. Material may be inappropriately described or subject to restrictions such as copyright, licensing and other limitations and it is the sole responsibility of those having access to such material to comply with any or all lawful obligations arising from such material coming into their possession and, thus mitigate any alleged transgression. All users undertake to comply with the national laws applicable to the country they reside in and observe the rights inherent in any copyright material whilst upholding the rights of any copyright owner. After your Intermaxx warranty and service offer ends, the service, including our website and devices and all content and software associated therewith, or any other features or functionalities associated with the our service, are provided “as is” and “as available” with all faults and without warranty of any kind. We make no representations or warranties of any kind with respect to the Intermaxx service, our website and user interfaces, and all content and software associated therewith. We cannot be liable for any loss of service or ‘down time’ of our service and not compensatory measures will be offered to consumers. You agree by accepting these terms that we may eliminate or otherwise modify any or all aspects of the any device or service, including features, without compensation or notice to you. We specifically disclaims liability for the use of apps or software (including their continuing compatibility with our device). Without limiting the foregoing, we assume no liability or responsibility for any of the following:

(i) Errors or omissions in the content streamed by the any device.

(ii) Recommendations or advice of our Customer Service department.

(iii) Any failure or interruption in the availability of Streams.

(iv) Delivery and or display of any content contained on the our website, or otherwise through any device.

(v) Any losses or damages arising from the use of the content streamed on any device including any losses or damages arising from downloading and installation of related software, downloading and/or use of any other software. To the extent allowable by UK law, we and our distributors disclaim all representations and warranties, including, for example, warranties of merchant ability, satisfactory quality, fitness for a particular purpose, and non-infringement. In addition, we do not represent or warrant that the information accessible via our website is accurate, complete or current. We do not make any representations with respect to the content streamed from any device or the descriptions of any streaming content contained on our website and user interfaces. We do not represent or guarantee that your use of the our service will be free from interruption, loss, corruption, attack, viruses, interference, hacking, or other security intrusion and we disclaim any liability with respect thereto. No oral or written information or advice given by us or our authorized representative shall create a warranty or otherwise constitute a representation binding upon us or its affiliated parties.

 

Product Warranty

The warranty for all items is 12 months from the purchase date unless a warranty term greater than this period is stated on the product page, advert or sales invoice. The warranty is ‘return to base’. This means will repair and restore all items within the warranty period by receiving the goods back to our depot. Returning the item will be at the responsibility of the custom, however, those charges will be refunded upon receiving a proof of postage and cost receipt. Postage charges will only be refunded if the item is deemed to be at fault. If an item has proved to have been misused or the reported fault is not due to the product, we will repair free of charge but postage will not be refunded

​In no event shall we, or its subsidiaries or any of their share holders, directors, officers, employees or licensors be liable (jointly or severally) to you for personal injury or any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, business interruption or any other commercial damages or loss, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of the any service, our website and user interfaces, and all contents and software associated therewith, or otherwise related to our service. In no event shall our total liability to you for all damages for losses arising from the use or inability to use our service, including our website and user interfaces, and all content and software associated therewith be greater than the replacement or refunding of a related order total. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose. If any applicable authority holds any portion of this section or other sections of these terms of use, including any portion of the

privacy policy to be unenforceable, then those portions deemed unenforceable shall be severed and the terms of use shall be enforced absent of those provisions and any liability will be limited to the fullest possible extent permitted by applicable UK law.

 

Usage Policy

Clients are only permitted to view content that they have the correct viewing license for. Content must not be downloaded or shared as per your viewing license. We do not provide any links to media, all submitted links are done by content providers who express that all the media provided is in the public domain and/or they have the correct license to share with the client. Anything the client views via any of our products is done so at their own risk.
